Terms of Service

You must be at least 18 and able to enter a binding contract under Indian law. Qweek Site is a business tool for real estate brokers, agents, developers and their teams. If you use it on behalf of a business, you confirm that you're authorised to accept these terms for that business.

Your account is linked to your WhatsApp number, which we verify with a one-time code. Keep your phone and codes secure: you are responsible for everything done through your account. Tell us straight away at hello@qweeksite.com if you think someone else has accessed it.

Give us accurate details and keep them up to date. One person per account; team accounts give each member their own login.

Qweek Site turns the property details, photos and messages you send us into listing pages, brochures and collections you can share, and shows you how people interact with them. We may use automated tools, including AI models, to read your messages and draft listings. Always review a listing before you share it: automated drafts can contain mistakes.

Qweek Site is software. We are not a real estate broker or agent, we don't take part in your transactions, and we don't guarantee any sale, lead or enquiry.

You keep all rights to the content you send us. You give us a non-exclusive, worldwide, royalty-free licence to host, copy, process, adapt (for example, resize photos or format text) and display it, only to provide and improve Qweek Site for you. This licence ends when you delete the content or your account, except for copies we must keep by law.

You confirm that for everything you publish through Qweek Site:

• you have the right to use it, including photos, floor plans and brochures supplied by developers;
• it is accurate and not misleading about price, area, approvals, possession or amenities;
• it complies with the Real Estate (Regulation and Development) Act, 2016 and your state's RERA rules, including showing RERA registration numbers where required, and with the Consumer Protection Act, 2019 and advertising standards.

We may remove or disable content that we reasonably believe breaks these terms or the law, or when a court or authority directs us to.

You can publish a website on Qweek Site at an address you choose (your “handle”). Everything in the section above applies to it, and in addition:

• your business name, logo and banner must be yours or used with permission. Don't pose as another broker, agency, developer or brand, or pick a handle that suggests you are one;
• keep your contact details and RERA registration current, and show your RERA agent registration number where your state's rules require it;
• testimonials and awards must be genuine. Publish a client's words only with their permission and without changing their meaning, don't write reviews yourself or offer anything in return for a good one, and list only awards you actually received. Misleading endorsements are covered by the Consumer Protection Act, 2019 and the CCPA's guidelines on misleading advertisements. Remove a testimonial when the client asks you to;
• handles are first come, first served. We may change or withdraw a handle that infringes someone's rights, misleads, or is offensive, and we'll tell you first where we reasonably can;
• when you change your handle or delete your website, the old handle stops working straight away and anyone can register it. It doesn't forward to your new address, so update links you've shared (links to individual listings and collections keep working);
• your website shows a small “Made with Qweek Site” link.

When people view your listings or contact you, Qweek Site records that activity for you. For this data you decide why and how it is used, so you are responsible for having a lawful basis to collect it and contact these people, and for honouring their requests (for example, to stop contacting them). We process it only on your instructions, as described in our Privacy Policy.

Don't use Qweek Site to send spam or unsolicited commercial messages, or to contact people registered on the National Customer Preference Register without consent.

You agree not to:

• publish fake, duplicate or bait listings, or properties you aren't authorised to market;
• upload anything unlawful, defamatory, obscene, or that infringes someone else's rights;
• impersonate anyone or misrepresent your RERA registration or affiliation;
• probe, overload or break our systems, scrape the service, or get around usage limits or security;
• resell or white-label Qweek Site without a written agreement with us;
• breach WhatsApp's Business and Commerce policies when using our WhatsApp features.

Pay per listing. Qweek Site is paid for with prepaid listing credits. One credit publishes one property listing, including its listing page, brochure and lead tracking. Editing a listing doesn't use another credit. 48 hours after a listing is first published, its category and location are locked to that property; a different property needs its own listing. Credits are sold in packs; current packs and prices are on our pricing page.

Free listings. New accounts get a number of free listing credits, shown on the pricing page, so you can try Qweek Site before paying. Free credits have no cash value.

No subscription. Each purchase is a one-time payment. Nothing renews automatically and we never charge you without you starting the payment.

Using credits. Credits are added to your account once the payment is confirmed and don't expire while your account is open. They are personal to your account: they can't be transferred, resold or exchanged for cash. A credit is used when a listing is first published; deleting a listing doesn't return its credit.

Prices. Prices are in Indian Rupees and are the full amount you pay; nothing is added at checkout. We may change prices at any time; changes never affect credits you've already bought.

Payment partners. Payments are processed by RBI-authorised payment aggregators (such as Razorpay). We never see or store your full card number, CVV or UPI PIN. Your use of their checkout is also subject to their terms.

All purchases of listing credits are final and non-refundable, including for credits you don't use. That's why every new account gets free listings to try Qweek Site first. The only exceptions are payment errors: a duplicate charge, or money deducted without credits being added. These are covered by our Refund Policy, along with anything else the law requires.

Parts of Qweek Site rely on services we don't control, including WhatsApp (Meta), hosting providers and payment partners. We aren't responsible for their outages or for changes they make, though we'll work to keep Qweek Site running. WhatsApp is a trademark of Meta Platforms, Inc.; Qweek Site is not affiliated with or endorsed by Meta.

We work hard to keep Qweek Site available and secure, but we can't promise it will be uninterrupted or error-free. We may add, change or remove features. If we change what a listing includes, we'll tell you in advance, and listings already published keep working.

You can delete your account at any time from your settings or by contacting us. We may suspend or close your account if you seriously or repeatedly break these terms, if required by law, or if your account puts other users or Qweek Site at risk. Where reasonable, we'll warn you first and give you a chance to fix the problem.

Unused credits are forfeited when your account is closed, whether you close it or we close it for a breach of these terms, and they aren't refunded. After your account closes, you can ask us for an export of your listings and leads within 30 days. After that we delete your data as described in our Privacy Policy.

Except as stated in these terms, Qweek Site is provided “as is” and “as available”, to the extent the law allows. To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost deals or lost commissions.

Our total liability for any claim relating to Qweek Site is limited to the amount you paid us in the 12 months before the claim arose, or ₹5,000 if that is higher. Nothing in these terms limits liability that cannot be limited by law, including for fraud.

You agree to compensate us for reasonable losses and legal costs arising from content you publish or from your breach of these terms or the law.

These terms are governed by the laws of India. Let's try to solve any dispute informally first: write to us and we'll respond within 15 days. If we can't resolve it within 30 days, the courts at Shrirampur, Maharashtra have exclusive jurisdiction, subject to any rights you have as a consumer under Indian law.

We may update these terms as Qweek Site or the law changes. For material changes, we'll notify you on WhatsApp, by email or in the dashboard at least 15 days before they take effect. If you keep using Qweek Site after that, the new terms apply; if you don't agree, you can stop using Qweek Site and close your account before they take effect.

Grievance Officer

Under the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, you can raise any complaint with our Grievance Officer, Kushal Gohil, at hello@qweeksite.com. We acknowledge complaints within 24 hours and resolve them within 15 days.
